Two new Bannockburn developments proposed A controversial subdivision in Bannockburn was currently in the process of being rezoned under Plan Change 19. FILE SHOT

Resource consent hearings for two separate Bannockburn developments will be held in February and March - one which will now be considered under the new Plan Change 19 rules.


DJ Jones and NR Searell Family Trust applied for a 24-lot subdivision at 88 Terrace Street last year, but the hearing had been put on hold and will now be heard by independent commissioners on March 4 and 5 in Cromwell.



The controversial subdivision initially received 77 submissions with 72 in opposition. It was then withdrawn and the current application lodged to replace it in its entirety.


The site was currently being rezoned Large Lot Residential under the new Plan Change 19 (PC19).


The applicants propose that Lots 1-20 would range in size from 1502 sqm to 2265sqm which has been assessed as a discretionary activity under the new plan.


A total of 38 submissions were received for the current application, two neutral and three in support and the remainder in opposition.


The majority of submissions in opposition were still concerned about the lot sizes.



In the planners report by Kirstyn Royce, the activity status of the application was fixed by the provisions in place when the application was first lodged, under the Resource Management Act.


“In this case, the activity retains the discretionary activity status set by the Operative District Plan. However, it is the provisions of both the District Plan and PC19 in force at the time of the decision that must have regard to when assessing the application. 


“While decisions have been released for PC19, the provisions are under appeal and greater weight is given to the operative District Plan.”



Meanwhile, a two-lot subdivision in Paterson Road by Clyde Orchards planning to develop the 20.2ha property for both residential and horticulture use, will also go to a hearing on February 11.


The site already contains an extensive orchard including a combination of cherries, peaches and nectarines.


A total of eight submissions were received by the close of the submission period. Two submissions were in support, three neutral, and three submissions were in opposition. 


All submitters, except for one, raised concerns with the use and on-going maintenance of Paterson Road. One submission raised concerns regarding visual effects and one raised concerns relating to rural amenity and character.


Planning consultant Kirstyn Royce has recommended it be approved.
