The owners of the new Night ‘n Day Clyde have been operating beyond the scope of their resource consent, and must now convince a hearing about the change of retail activities.
Originally the site of the Clyde 4 Square supermarket since 1904, the business was rebranded to Night ‘n Day in January and planned to extend the opening hours in the evening from 8pm to 11pm, most recently offering deep-fried takeaway meals prepared onsite.
Central Otago District Council (CODC) determined that the scope of the activity—both in terms of trading hours and the shift in character to a hybrid convenience and takeaway food model—exceeded the existing use rights previously associated with the Four Square operation.
The report from council to a hearings panel (scheduled for July 16) said the business consent did not authorise any changes to the nature or scale of the underlying retail activity, and the owners have had to apply for a new one to be able to open from 6am to 11pm.
In March CODC determined to notify the application, with notices served on properties located immediately adjoining or opposite the site, that had not provided written approval.
Although the site is located on the edge of the Clyde Heritage Precinct and slightly removed from the town centre it is still considered part of the main retail area, but one neighbour wasn’t happy about the smell or noise from the late night operation.
The Night ’n Day Clyde has been operating since January 2025.
While consultant planner Oli Monthule-McIntosh has recommended the consent be approved, he suggested a condition be made to restrict the preparation and sale of hot food to between 7am and 8pm.
“These limits would better align the activity with the surrounding residential context and reduce the risk of adverse amenity effects during sensitive early morning and late evening periods,” he said.
