Law: Legal advice for what to do when the relationship is over

The end of the holiday season can be a challenging time, especially if it coincides with the end of a relationship for some couples.

During this emotional process, it can be an unsettling and difficult time, not to mention adding extra stress on top of your usual responsibilities.

There can be a lot of challenging aspects, and if you're navigating the aftermath of a recent breakup, it's completely understandable to have a whirlwind of concerns about finances, property, childcare, and the division of assets—each adding to the emotional weight of separation.

If this sounds like your current situation we are here to help.

Relationship property

If you and your ex-partner were together for three years or more, you are likely entitled to a 50/50 split of relationship property. But every situation is unique.

Relationship property usually includes the family home and chattels such as furniture, cars, tools, appliances and even pets.

It can also include shares, investments, additional properties, Kiwisaver and Superannuation schemes.

Parenting

If you and your partner have kids together,  you might be wondering about everyday child care.

Sometimes it's hard to agree. If you are unable to reach an agreement with your ex-partner, you may wish to attend family mediation or seek a Parenting Order from the Family Court.

Mediation in many cases can be a helpful and effective way to resolve disputes and come to agreements during a breakup. Mediation involves a neutral third party who helps facilitate communication between both parties and assists in finding mutually acceptable solutions.
